This applies to 3 Helps Pty Ltd (54 648 135 737), the Parent Company and One Another Community Pty Ltd (60 640 024 764), the Subsidiary Company.

Your use of our Website and App indicates that you have read and accepted these Terms of Use and you warrant that you have the legal capacity to accept these Terms of Use.

We are committed to protecting your privacy. Our privacy policy is available at www.oneanother.io/privacy-policy. By agreeing to these Terms of Use, you also agree to the terms in our privacy policy.

Acceptance of Terms and Conditions

These terms and conditions outline the rules and regulations for the use of One Another’s services. One Another (60640024764) is located at: U5 76-80 Kenneth Road, Manly Vale NSW 2093, Australia.

All terms refer to the offer, acceptance and consideration of provision of services/payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of One Another’s stated services/products, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

Our Responsibilities

One Another will:

  1. treat you with courtesy and respect, and communicate openly and honestly;
  2. consult with you about how and when support services are provided and undertake periodic reviews with you;
  3. share your information with key One Another staff, including internal auditors, as well as other external service providers in order to provide support services to you;
  4. make information accessible to you about feedback, complaints, privacy and confidentiality, and your rights to advocacy;
  5. protect your privacy and confidentiality in line with One Another’s Privacy Policy (One Another may be required to disclose personal or confidential information by law);
  6. provide support services to a professional standard and with appropriate care, skill and otherwise in a manner consistent with all relevant laws; and
  7. (g) keep accurate records and issue regular invoices and statements about support services provided to you.

User Terms and Conditions

By accessing or using our online services you agree to be bound by the terms and conditions set out below (Terms) as well as our Privacy Policy as updated from time to time and accessible at: www.oneanother.io/ (Privacy Policy). If you do not accept or agree with these Terms or our Privacy Policy, you must not use our online services. We reserve the right to modify these Terms from time to time without notice.

Accounts

When you create an account with One Another, you guarantee that you are above the age of 18, and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

  1. You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account.

  7. any content or material, including but not limited to user messages/reviews posted on www.oneanother.io/ website. Please notify us immediately if it is believed that any content or material posted on www.oneanother.io/ website infringes on any copyright.

Agency

One Another acts as an information platform only. We do not on-sell on behalf of service providers, such as cafes, retail or other category listings.

We are not the provider of such products or services (which do not form part of the Service) and our role in relation to facilitating information and therefore we have no responsibility for these products and services nor do we make or give any warranty or representation regarding their standard, reliability, accuracy or suitability.

As this will be with the third-party provider (and not One Another), any legal recourse or claim shall be made against the specific service provider (and not One Another). If for any reason, any service provider is unable to provide the products and services for which you have contracted your remedy lies against the provider and not with One Another.

You acknowledge that we may receive a commission or an affiliate fee from transactions entered into using the Service. We may have contributors review products or services.

However we do not endorse or recommend any particular service provider and you should make your own evaluation of the accuracy or completeness of any information, opinion, advice or other content available through the Service.

By creating an account on the One Another platform, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or instructions provided in any email we send.

Personal information (Name, Email, Postcode) collected during a Giveaway will be added to One Another’s database and shared with the Third Party. Answers provided within the Giveaway may be used for market research purposes. Other External Activities may be subject to separate terms and conditions.

You acknowledge that you participate in any External Activities entirely at your own risk. In relation to External Activities conducted by any third party (even if such third party has been contracted by us or we are associated with such activity), we do not accept any liability for any loss, damage, cost or expense that you suffer or incur as a result of or in connection with your participation in such External Activities.

In relation to External Activities conducted by us, to the maximum extent permitted by law, we exclude all implied representations and warranties which, but for One Another Terms, might apply in relation to your participation in relation to such External Activities. To the extent that our liability cannot be excluded by law, our maximum liability to you will be limited to the amount paid by you (if any) for your participation in the event.

These Terms shall be governed and construed and interpreted in accordance with the laws of each state within Australia, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.

You acknowledge that we are not responsible for, and accept no liability in relation to, your use of and conduct in connection with One Another, or any other members’ use of or conduct in connection with One Another.You agree to indemnify us for any loss, damage, cost or expense that we may suffer or incur as a direct or indirect result of or in connection with your use of or conduct in connection with the One Another website, including any breach by you of One Another Terms and from any Content or User Content you post.

Nor do we make any representation or warranty about the likelihood of any outcomes of your use of the One Another website. To the extent that our liability cannot be excluded by law, our maximum liability to you will be limited to the total amount paid by you (if any) for any chargeable service or feature on the One Another website purchased by you during the term of your membership.

In no circumstances will we be liable for any indirect, punitive or consequential loss or damages; loss of income, profits, goodwill, data, contracts, use of money; or loss or damages arising from or in any way connected to business interruption of any type, whether in tort, contract or otherwise.

By posting User Content you agree to indemnify and keep indemnified One Another, its officers, employees and agents against all claims, suits, actions, liabilities, actual or contingent costs, damages and expenses incurred by One Another in connection with any User Content. One Another makes no representations or warranties of any kind, express or implied as to the operation of the Website or User Content.

Membership and Subscription

When registering as a member of One Another, you are responsible for providing accurate and up-to-date information. Should your listing information change it is your responsibility to inform us of any changes to that information. You may do this at any time by accessing your Listing page on the One Another website or by contacting us at EMAIL.

  1. All personal information you provide to us will be treated in accordance with our Privacy Policy.
  2. All payment transactions are processed in Australian Dollars (AUD)
  3. As a member of One Another website will be automatically deducted. Payments will be scheduled to automatically occur. If you do not opt-out your subscription membership it will automatically renew at the end of term period for the same previously signed duration and amount.
  4. In the event that you do not opt-out of your auto-renewal or cancelled your membership any amounts deducted are non-refundable and any payments due (or outstanding) will become due immediately.
  5. One Another does not provide refunds in the event that you have changed your mind.


Suspension or Termination of Membership

  1. By providing written notice to us you may terminate your membership to One Another for any reason. You can provide notice of termination by:
    1. Going to Account settings selecting ‘cancel account’ and following the instructions; or
    2. emailing us via the Contact Us page; or
    3. mailing it to our postal address listed on the Contact Us page.


We reserve the right to, without limitation, do any or all of the following in relation to your membership:

  1. suspend your membership;
  2. modify your member profile;
  3. permanently or temporarily hide all or part of your member profile;
  4. terminate your membership for any reason by providing notice to you by email;
  5. terminate your membership immediately without notice to you if you have committed a breach of One Another terms; and
  6. permanently or temporarily block your access to all or part of the One Another website.


All personal information you provide to us will be treated in accordance with our Privacy Policy.

Reservation of Rights

We reserve the right at any time and in its sole discretion to request that you remove all links or any particular link to our website. You agree to immediately remove all links to our website upon such request. We also reserve the right to amend these terms and conditions and its linking policy at any time. By continuing to link to our website, you agree to be bound to and abide by these linking terms and conditions.

Removal of Links
